BarBri was down today.  So I focused on making flashcards in ANKI for CivPro, and also reviewed materials.  I'm moving unusually slow right now.  But, I will be ready for the BAR!

Assignment for Today.

  • Civ Pro - lectures & outlines!
  • Barbri's "How to Review Multistate Explanatory Answers" and
  • MBE Torts Workshop (25 Qs)

Comments:  I have a good breath knowledge understanding of Torts. I, however, will need to dig deeper into some highly testable topics, such as product liability and negligence.  I plan to also deconstruct some model essays answers for some previous Tort Bar Exam questions.  More to come.

MBE - Tracking my performance

Caveat: I am still refreshing my memory on the topics for the exam.  The BarBri program has not yet begun, however, I have started taking sample MBE questions to gauge my baseline.  The passing threshold is around 64% correct on the MBE, but, I would like to be way above this %.

Created an outline for the Equal Protection Clause under the 14th amendment, that identifies the three factors/checklist - (1) Gov (state) action; (2) Facial or Application Challenge; (3) Review Standards based on classification - e.g., strict scrutiny = 'suspect' classes or fundamental right impeded; intermediate scrutiny =quasi-suspect; rational basis review = other classification.

I plan to track my performance using Excel.
